David is a partner in our dispute resolution team and is Chairman of the Kensington Swan Board. He specialises in helping clients resolve commercial and civil disputes, with a particular focus on competition law, product liability, and liability insurance.

David has been involved in major cases involving the Commerce Act. He also advises private clients on disputes over wills, estates, and trusts, and he has experience in media law and defamation.

David works with our construction team on the insurance issues that arise out of construction disputes.

David advises listed companies, multi-national companies and significant private companies and individuals. He is experienced in a wide range of dispute-resolution methods, and has appeared before arbitrators, mediators, tribunals and the courts.

No matter what your dispute is about, David’s many years of experience means he can identify the options available to you develop a strategy to help you achieve the best commercial outcome as quickly and cost-effectively as possible.

David has a long association with the New Zealand Law Society and is currently President of the Auckland Branch.

David has acted for: 

  • DePuy International Limited in a successful opposition to a novel class action for compensatory damages where alleged personal injuries are covered under the Accident Compensation Act 2001.
  • The trustees of New Zealand foreign trusts for the benefit of Sergei Pugachev and others.
  • Woolworths, Foodstuffs, Dick Smith, Noel Leeming, Farmers and Whitcoulls in significant Commerce Act proceedings regarding credit card interchange fees and the alleged anticompetitive effect of Visa and Mastercard schemes. 
  • Suppliers in relation to pharmaceutical pricing and procurement disputes.
