We assist with all aspects of formation of charities and not for profit organisations, including the preparation of trust deeds, constitutions and rules and the establishment of governance procedures.. 

 

The Charities Act 2005 will be particularly significant for not for profit organisations and we can provide advice on the implications for such organisations, as well as assisting with registration on the Charities Register administered by the Charities Commission.  Such registration will soon be a pre-requisite for relevant not for profit organisations to maintain “charitable status” and continue to be eligible for certain tax and gift duty exemptions. In some cases registration may require changes to governing documents. It will therefore be important to prepare well in advance for registration as such changes can take longer than expected, in particular to gain approval from organisation members.

 

We can also assist in dealing with constitutional issues you may face such as:

The on-line Charities Register opened for registrations on 1 February 2007 and charitable organisations have from this date until 1 July 2008 to register as a charitable organisation before tax laws change and any existing tax exemptions are affected.
