Duncan has joined
Kensington Swan as a specialist construction and projects lawyer
having previously, worked for 7 years in the UK’s
pre-eminent construction law firm Pinsent
Masons.
Duncan’s
practice involves both the drafting and negotiating of construction
contracts, and the managing and resolving of construction
disputes. He has advised both the public and the private sector
on construction contracts of all sizes, including substantial
projects procured using public-private structures such as PFI, LIFT
and BSF. He is experienced in drafting consultants appointments,
collateral guarantees, bonds and associated documents, and is familiar
with the industry’s standard forms including 3910, FIDIC and
NEC.
Duncan has taken
disputes through mediation, arbitration, adjudication and court
proceedings and has managed to resolve many matters through
negotiation.

most recent experience includes:
Advising
Dorset County Council on their c$220 million Public Private
Partnership for the replacement of street lighting.
Advising
Birmingham City Council on their Public Private Partnership for the
construction of 11 new schools.
Drafting
the construction documents for a distribution company’s
replacement of 12 depots’ (combined value over $60m).
Drafting
the construction contracts for a shopping and leisure complexes
ranging in value from c$35m to $60m.
Advising
an international contractor on a series of disputes in relation to
airport and infrastructure projects in the Caribbean
procured under FIDIC conditions.
