The Consumer Guarantees Act gives consumers the benefit of certain “guarantees” for goods and services ordinarily acquired for personal, domestic or household use.  

 

Course Content

The Act applies to all suppliers of goods or services to consumers in trade, whether the suppliers be individuals or companies. The supply may be by way of sale, gift, exchange, lease, hire or hire purchase. The Consumer Guarantees Act  does not apply to commercial  or industrial goods and services.

  

In respect of goods, the Act provides consumers  with specific guarantees regarding acceptable quality, fitness for purpose, title, price, repairs, and spare parts, correspondence with sample and correspondence  with description.

  

In respect of services, the Act provides consumers with specific guarantees regarding reasonable skill and care, fitness for purpose, time of completion and price. Where any of the guarantees are breached, consumers have remedies under the Act against both suppliers and manufacturers. Even where a customer has purchased goods from a supplier, they will still have rights against the manufacturer.

   

Where guarantees have not been complied with, the supplier may be required to replace the product or refund the purchase price.

   

This course is for all businesses who deal with the public and particularly those selling goods or providing services must understand the effect of the Act and the consequences of non-compliance.
