Trusts team provides experience in trading trusts, foreign trusts, family
trusts, trusts created by will, charitable trusts, trust migration and
trust administration. We are involved in advice on all aspects of trust
law, in the establishment of private trust companies and in the
administration of trusts.
One of our
strengths is advising clients about the use of trading trusts
as business structures, particularly for overseas clients, and
the establishment of corporate trustees for such trusts.
In the foreign
trust area, we advise overseas clients regarding the
establishment of trusts with New Zealand
resident trustees, the use of New Zealand
as a tax haven and the proposed new disclosure rules
which will affect foreign trusts. Where an overseas jurisdiction has
suitable companies legislation, we give advice relative to the
migration of trusts to and from New Zealand
and we are able to provide advice on inbound and outbound trust
planning for individuals moving to and from New Zealand.
We have
extensive experience in the use of family trusts as part of estate
planning - where the trust structure is used to protect
assets against creditors and to preserve assets for the benefit of
present and future family members.
The Charities
Act 2005 is the most recent piece of legislation that governs how
trusts are formed and administered. Our trust team has a
thorough understanding of this Act and can apply this knowledge to
benefit our clients.
