Kelly Wilshire is a Senior Associate
in the Construction team specialising in contentious construction issues,
advising principals and major contractors on claims, project recovery
and contract administration issues.
Kelly has acted in several complex multi-party arbitration, mediation
and court proceedings in New Zealand
and Australia.
Kelly regularly advises on issues such as payment, defects liability,
delay/disruption and performance bonds/bank guarantees.
Recent examples of Kelly’s work include:
Advising head contractor on NZD$4m dispute, including injunction
proceedings, arising under contract for design and construction of an
ocean outfall project
Advising a head contractor on entitlements under contract for design
and construction of extension to State Highway 16
Acting
for the head contractor in a multi-party claim against the design
consultants and subcontractors involved in the redevelopment of an
international hotel
Advising
a principal in relation to various disputes arising under an AUD$80m
design and construction contract including an AUD$12m claim under the
NSW Security of Payment legislation
Acting
for the head contractor in arbitration proceedings relating to the
design and construction of a vehicular tunnel in the Sydney CBD
Acting
for a contractor on expert determination proceedings, and advising on
the administration of a contract with the NSW government, for the
design and manufacture of rolling stock.
Kelly is currently studying for her Master of
Construction Law degree at the University
of Melbourne.
In 2007 she was an assistant lecturer in the faculty of Civil
Engineering at the University
of Sydney,
lecturing an undergraduate course on construction ‘Contract
Formulation and Management’.
Prior to joining Kensington Swan, Kelly spent four years in Sydney
working in the Litigation department at Freehills
and the Construction & Engineering law group at Mallesons Stephen Jaques
where she was a Senior Associate. Kelly previously worked in the
commercial litigation department in another top tier law firm in Auckland,
specialising in construction litigation.
