Katrina joined Kensington Swan’s litigation team
in 2006, and was promoted to Associate in 2008.
She specialises in insolvency and property-related litigation, in
particular the enforcement of payments arising under the
Construction Contracts Act 2002.
Katrina was
co-counsel in the Court of Appeal and in the Supreme Court in Laywood v Holmes Construction Wellington Ltd
[2009] 2 NZLR 243, which determined that construction contract debts
were capable of enforcement through bankruptcy notices (and likely
statutory demands). It is also the leading
case on various aspects of enforcement procedure.
She has
since assisted Queens Counsel in the first decision relating to
associate owner liability under the Construction Contracts Act 2002.
Katrina is
the firm’s leading expert on voidable
preferences. She acted for the creditor (Blanchett v The Roofing Specialists Ltd (2009)
10 NZCLC 264,583).
Katrina has provided litigation support to US lawyers in
relation to a Chapter 11 Bankruptcy and assisted in obtaining an
order from the New Zealand Courts recognising the Chapter 11
Bankruptcy under the Insolvency (Cross-border) Act 2006 (the first
application of its kind).
