Julian is an associate in Kensington
Swan’s Advocacy team and specialises in Building and
Construction Law.
He is currently based in Kensington Swan’s Abu Dhabi
branch in the United Arab Emirates.
Julian advises a wide variety of clients in New Zealand,
Australia
and the United Arab Emirates
on both small and large scale construction projects, construction
disputes and construction debt recovery procedures.
Julian regularly advises clients on:
standard form construction contracts
including NZS3910:2003 and NZIA SCC:2007
the Weathertight
Homes Resolution Services Act 2006
the Construction Contracts Act 2002
the Building Act 2004.
Julian’s recent work includes:
advising head contractors on the scope of
their duty of care and contractual obligations regarding multi-unit
residential developments, holiday resorts, schools and large civil
earth work contracts
advising head contractors on contractual
disputes including those arising out of a major tunneling
project and a drilling operation
advising home owners, contractors and
developers on large scale building defect claims including
‘leaky building’ claims
appearing in the High Court, the District
Court and the Weathertight Homes Resolution
Services Tribunal on behalf of owners and main contractors for
mediations, adjudications, arbitrations and general construction
litigation.
