Baden is a Senior Associate in the Māori Legal Group of Kensington Swan. He
joined the firm after working at both the Te Ohu
Kai Moana (Treaty of Waitangi Fisheries Commission) and the Ministry
of Fisheries.
Within the Māori Legal Group, Baden
specialises in a wide range of issues relating to natural
resources. He is particularly experienced in Māori
fisheries issues, and has worked extensively on a range of issues
relating to the Māori Fisheries
Settlement. Baden
has a detailed knowledge of the requirements of the Māori Fisheries Act 2004 including the
establishment of Mandated Iwi
Organisations, the development of coastline agreements and the
resolution of disputes relating to the allocation of fisheries
settlement assets. Baden
also has extensive experience in a range of customary and non
commercial fisheries issues.
Baden has also provided both policy and legal
advice to a wide range of organisations (including government
agencies and iwi) on a raft of fisheries
and coastal/marine issues including fisheries management under the
Fisheries Act 1996, aquaculture and aquaculture reform, marine
reserves, and foreshore and seabed issues. He has also worked on a
wide range of forestry and climate change issues for a range of
clients, particularly re. Crown forest licensed lands.
Baden is also extensively involved in the
negotiation and settlement of Treaty of Waitangi claims. He is
experienced in the various phases of the settlement process. Baden has
also appeared before the Waitangi Tribunal and Parliamentary Select
Committees in relation to a range of coastal marine issues as well as
historical Treaty grievances.
His work also includes establishing governance structures for Māori organisations, as well as general
commercial issues facing Māori
organisations. Working in a number of roles with government
organisations and iwi also means Baden
has experience in issues relating to consultation between Māori and Government.
